ABOUT THE NDIS QUALITY AND SAFEGUARDS COMMISSION

The position is part of the Commission’s NSW Regional Office and will be located in Penrith, after an initial temporary period in Parramatta.

The Department of Social Services (DSS) is the Australian Government’s lead agency in the development and delivery of social policy, and is working to improve the lifetime wellbeing of people and families in Australia. The NDIS Quality and Safeguards Commission (the Commission) is being established by DSS as part of the rollout of the National Disability Insurance Scheme (NDIS). The Commission will be the dedicated national regulator of service providers in the NDIS market in Australia, and a non-corporate entity under the Public Governance, Performance and Accountability Act 2013.

Key functions of the Commission include registration and regulation of NDIS providers, including Practice Standards and a Code of Conduct; compliance monitoring, investigation and enforcement action; responding to complaints and reportable incidents including abuse and neglect of a person with disability; national policy setting for the screening of workers; national oversight and policy in relation to behaviour support and monitoring restrictive practices within the NDIS; and information sharing arrangements.

The Commission will commence operations in New South Wales and South Australia on 1 July 2018 when those jurisdictions complete the transition to full scheme. The Commission will then expand its operations to other jurisdictions, and is due to complete the transition to full roll out by 1 July 2019.

WHAT THE COMPLAINTS MANAGEMENT BRANCH IS RESPONSIBLE FOR

The Branch is responsible for the promotion and protection of the rights of NDIS participants through effective complaints handling and reportable incidents handling functions. This supports better outcomes for participants, providers (of NDIS-funded supports, and information, linkages and capacity-building supports) and the NDIS market place where a provider has breached the NDIS Code of Conduct, or where there are broader issues about service quality or concerns about safety, abuse and neglect.

The Branch also provides an educative role in the effective handling of reportable incidents and in their identification, prevention and management. The reportable incidents handling function is responsible for receiving and responding to reportable allegations notified to the Commission about the provision of supports and services by NDIS providers.

The Commission does this through assessment and investigation (and escalating to a formal Commission-led investigative function where necessary), providing information and advice about the Commission’s reportable incidents process to NDIS participants, and providing advice, information and training about reportable incidents handling to NDIS providers. The reportable incidents handling function also reviews relevant data to identify systemic issues, and to investigate potential breaches of the NDIS Code of Conduct.

WHAT YOU WILL DO

Reporting to the Director, and as part of a small state-based team, you will undertake the following:

1. Support the implementation, operation and monitoring of the reportable incidents handling function, consistent with the NDIS Quality and Safeguarding Framework and the National Disability Insurance Scheme Act 2013, and relevant Commonwealth legislative requirements.

2. Assist with the management of a caseload of incidents reported to the Commission by providers, including engaging with providers, where requested, on incidents (including deaths of people with disability) and supporting the Assistant Director in the escalation of incidents for investigation or other action where necessary.

3. Support the education and training function for providers in identifying incidents, preventing and effectively responding to abuse, and neglect of people with disability and information about the Commission’s reportable incidents handling function.

4. Develop productive working relationships with a range of stakeholders to facilitate the work of the reportable incidents handling function, and the Commission more broadly.

5. Support the development of advice to the Branch Manager about trends, issues, individuals of concern and inadequate investigations by service providers, through the assessment and analysis of information gathered during the reportable incidents handling process.

6. Behave in accordance with the values promoted by the Commission.

7. The ability, and the confidence, to make sound judgements and decisions based on thorough research, problem-solving, innovation and evidence-based practice, to achieve the objectives of the reportable incidents handling function, and the Commission more broadly.

Desirable:

1. An understanding of the NDIS Quality and Safeguarding Framework and the NDIS Act.

2. Lived experience of disability or demonstrated understanding of disability services in a state or territory government context.

3. An appreciation of investigation skills in the context of responding to serious incidents and supporting vulnerable groups of people.

Note: The position will be located in Penrith, after an initial temporary period in Parramatta.

The suitable applicant may also be required to obtain and maintain a security clearance conducted by the Australian Government Security Vetting Agency (AGSVA). To be eligible to obtain a security clearance (Baseline, Negative Vet 1 or Negative Vet 2) applicants must be an Australian Citizen.

Applicants also must be able to establish their background as checkable to be considered eligible for a security clearance. Any gaps or periods of time spent overseas for 12 or more months (cumulative) that cannot be verified by an Australian referee is deemed uncheckable, rendering the applicant ineligible for a security clearance. Background history must cover 5 / 10 years (Baseline / Negative Vet 1 or Negative Vet 2) of employment, education, residential, criminal history and anything else specified by the AGSVA. The suitable applicant must be willing to disclose all relevant and required information to fulfil this process.
