The Minister Assisting the Prime Minister for the Public Service is seeking expressions of interest in appointment to the full time statutory position of Merit Protection Commissioner.

The statutory position of Merit Protection Commissioner is established under the Public Service Act 1999. It is an independent office located within the Australian Public Service Commission.

The Merit Protection Commissioner has an important role in assisting agencies to meet the requirements of the APS Values and Code of Conduct through the administration of the statutory review of actions scheme.

In addition to administering the statutory review of actions scheme, there are a range of other responsibilities, as set out in sections 50 and 50A of the Public Service Act 1999. This includes fee for service functions such as conducting inquiries into whether APS employees have breached the Code of Conduct and providing independent merit-based selection services.

The Merit Protection Commissioner is appointed by the Governor-General on a full-time basis for a period of up to five years. Conditions of appointment of the Merit Protection Commissioner are determined by the Minister after consultation with the Remuneration Tribunal.

The Remuneration Tribunal recently determined that the Total Remuneration Package for the Merit Protection Commissioner was $266,350. This includes salary, employer superannuation contributions and other non-monetary benefits provided at the employer’s expense such as vehicle parking.
